By purchasing and/or using Hyperflyer Credits as defined below, you accept the following terms and conditions:

This Hyperflyer Credits Purchase Agreement (“Agreement”) is between and among Hyperflyer, Inc. (“Hyperflyer”), the purchaser and/or redeemer of Hyperflyer Credits (“you”).

“Hyperflyer Credits,” for the purposes of this Agreement, means: (i) a load amount value, which is issued directly to you by Hyperflyer for use in your Hyperflyer account, and (ii) in other cases, discretionary or “bonus” value provided to you by Hyperflyer, without consideration, as a promotion or for appeasement purposes for use in your Hyperflyer account. For the purposes of clarity and avoidance of doubt, solely as used in this Agreement, Hyperflyer Credits does not mean any amount earned by you as a result of your providing services to Hyperflyer.

You must have an active and valid Hyperflyer account to obtain and to redeem Hyperflyer Credits, and your use of Hyperflyer Credits is subject to the Hyperflyer Terms of Service. Hyperflyer may from time to time request information from you to confirm your identity before it will allow use of Hyperflyer Credits or as otherwise in order to comply with relevant anti-money laundering laws. Hyperflyer may delay your access to the Hyperflyer Credits services until you comply with this information request. Hyperflyer Credits may only be redeemed via the Hyperflyer app, and used within the United States. Hyperflyer reserves the right to modify the scope of services for which Hyperflyer Credits can be redeemed. Hyperflyer Credits may not be redeemed outside of the United States. No portion of Hyperflyer Credits are transferrable to another party.

The Hyperflyer Credits and Hyperflyer Gift Card cannot be reloaded with additional funds after purchase and no fees apply to the Gift Card. The load value of Hyperflyer Credits purchased by you never expires; Hyperflyer credits provided to you by Hyperflyer, however, may expire as determined by Hyperflyer. You will receive notice of any applicable expiration date upon receipt of the Hyperflyer-provided Hyperflyer credits.

No portion of Hyperflyer Credits is refundable, returnable, or redeemable for cash except where required by law. Hyperflyer is not responsible for unauthorized use of Hyperflyer Credits. Hyperflyer reserves the right to suspend or void their respective portions of Hyperflyer Credits if Hyperflyer suspects that the Hyperflyer credits was obtained or used fraudulently, unlawfully, or otherwise in violation of this Agreement.

Hyperflyer may modify any of this Agreement’s terms and conditions at any time, with or without notice to you, subject to applicable law. Hyperflyer may also modify the terms and conditions of the Gift Card at any time, with or without notice to you, subject to applicable law. The most current Agreement shall be available at hyperflyer.com/terms-of-hyperflyer-credits, and will supersede all previous versions of the Agreement. The most current Agreement shall be effective upon Hyperflyer’s posting of such modified Agreement. Your use of any portion of Hyperflyer Credits after such posting constitutes your acceptance of the modified Agreement. If any term of this Agreement is deemed to be invalid, void or for any reason unenforceable, such term shall be deemed severable and will not affect the validity and enforceability of any remaining terms of this Agreement.
